RULES FOR THE PRIZE DRAW WITH A PURCHASE REQUIREMENT

Article 1. Organiser

The company Laboratoires üma, a simplified joint-stock company registered with the Lyon Trade and Companies Register under number 981 407 158, whose registered office is located at 31 rue de Brest, 69002 Lyon, France, hereinafter the "Organiser", is organising a prize competition with a purchase requirement entitled "üma Évasion Marrakech", hereinafter the "Game", accessible via the umawell.fr website. Contact: bonjour@umawell.com.

Article 2. Purpose and duration of the Game

The Game is a prize competition with a prize draw, participation in which is linked to the purchase of the Organiser's products, in accordance with Article L121-20 of the Consumer Code. It runs from 20 July 2026 at 00:00 to 20 August 2026 at 23:59, Paris time, hereinafter the "Game Period". Any order placed outside the Game Period does not entitle the customer to participate.

Article 3. Conditions of participation

The Game is open to any natural person who is of legal age on the date of their participation, has a customer account on the umawell.fr website, and resides in one of the following countries: mainland France, including Corsica, Belgium, Luxembourg, Germany, the Netherlands, hereinafter the "Participating Countries". Overseas collectivities and departments are excluded from the Game.

Excluded from any participation are: employees, directors, and corporate officers of the Organiser and of the company UMAWELL GLOBAL, RCS Lyon 938 872 561, members of their household, as well as any person who has directly collaborated in the organisation of the Game, in particular service providers, agencies, and the judicial officer, and members of their household.

Participation is limited to one customer account per individual, assessed on the basis of the name, postal address, and email address. Creating multiple accounts or using inaccurate contact details results in the disqualification of all corresponding entries.

Article 4. Entry mechanics

During the Game Period, each programme, that is, each unit of product, purchased on the umawell.fr website and not cancelled or refunded under the conditions of Article 12 automatically entitles the customer to one entry into the prize draw. An order containing several programmes entitles the customer to as many entries as programmes purchased. Orders placed under an active subscription entitle the customer to the same number of entries as one-off orders, at the rate of one entry per programme delivered during the Game Period.

No other formality is required. Participation in the Game constitutes full and unconditional acceptance of these rules.

Any participant may request to be excluded from the prize draw, without affecting their order, simply by emailing bonjour@umawell.com before the draw date.

Article 5. Prize package

The Game includes a single prize awarded to one winner, made up as follows:

  • A stay for two people at the Club Med La Palmeraie resort in Marrakech, Morocco, rated 4 Tridents under Club Med’s internal classification, lasting six days and five nights, in a standard-category double room, on an all-inclusive basis under the Club Med package conditions in force on the booking date;
  • Return economy-class flights for two people to Marrakech, departing from one of the following airports, determined according to the winner’s country of residence: Paris, Lyon or Nice for France, Brussels for Belgium, Luxembourg for Luxembourg, Berlin for Germany, Amsterdam for the Netherlands, the final choice of airport and flights being at the Organiser’s discretion in coordination with the travel operator;
  • Shared transfers between Marrakech airport and the resort, as included in the travel operator’s package;
  • A lump-sum pre- and post-travel allowance between the winner’s home and the departure airport, capped at one hundred and fifty euros incl. VAT per person, i.e. three hundred euros incl. VAT in total, paid after the stay upon presentation of nominative supporting transport documents: second-class train ticket, coach ticket, or mileage allowance calculated according to the applicable tax scale.

The value of the stay and flights package is three thousand five hundred euros incl. VAT, i.e. a maximum total value of the prize of three thousand eight hundred euros incl. VAT, including the travel allowance. This value is determined on the basis of the travel operator’s quote on the date these rules are drafted, it may not be disputed and no compensatory payment will be made in the event of any difference from the prices applicable on the booking date.

The trip is booked by the Organiser with Club Med, a registered travel operator, which ensures the performance of the transport, accommodation and catering services. The Organiser does not act as a travel organiser or retailer within the meaning of the Tourism Code, it funds the prize and provides it in the form of a personalised travel voucher.

Article 6. Elements not included in the prize package

Are not included in the prize package and remain the sole responsibility of the winner and the person accompanying her:

  • Any service not expressly mentioned in Article 5;
  • Personal expenses within the resort: supplements and room upgrades, including the Espace Riad, treatments and spa, excursions and paid activities outside the all-inclusive package, premium drinks and menus outside the package, shop purchases, laundry, communications, tips;
  • Meals, drinks and expenses incurred during journeys and at airports;
  • Costs for obtaining or renewing passports and any identity or travel document, as well as completing the administrative and health formalities required for entry into Morocco;
  • Any optional insurance, in particular cancellation insurance, baggage insurance, comprehensive travel insurance, and any assistance or repatriation cover beyond those automatically included in the travel operator's package; the winner is invited to check her personal coverage before departure;
  • Repatriation, hospitalisation and medical costs incurred during the stay, beyond the guarantees automatically included in the package;
  • Excess baggage and paid airline options: seat selection and cabin upgrade;
  • Pre- and post-transport costs exceeding the cap set in Article 5;
  • Tourist taxes and local fees not included in the package;
  • Costs for modifying, rescheduling or cancelling the stay attributable to the winner or her companion.

The prize is nominative. It may not be assigned, sold or exchanged, nor may it be redeemed for cash, in whole or in part.

Article 7. Conditions for using the prize

The stay must be taken within twelve months from the announcement of the results, subject to the travel operator's availability and excluding the period from 19 December to 3 January inclusive. The dates are chosen by the winner from the availability proposed and confirmed by the travel operator.

The winner must be one of the two travellers. The accompanying person is either an adult or a minor under the winner's legal responsibility. The winner and her companion must each have a valid passport covering the entire stay, the national identity card not being sufficient for entry into Morocco, and must comply with all entry formalities in force on the travel date.

In the event that it is impossible to travel due to the winner or her companion, in particular in the event of invalid travel documents, denied boarding, cancellation on their part, or failure to present themselves, the prize is definitively forfeited, with no postponement, replacement or compensation of any kind.

Article 8. Designation of the winner

The draw will be held on 27 August 2026 from among all valid entries, using a random draw tool ensuring equal chances among entries. One winner and three alternates will be drawn, ranked in the order drawn, to replace the winner in the cases provided for in these rules.

Article 9. Announcement of results and acceptance

The winner will be informed personally by email at the address associated with her customer account, within seven days following the draw. To accept her prize, she must reply within seven calendar days from the sending of this notification and provide the requested supporting documents: a valid identity document proving she is of legal age, and proof of residence in one of the Participating Countries.

If no complete response is received within this timeframe, or if the entry conditions are not met, the prize will be offered to the first runner-up, on the same terms, and then, where applicable, to the subsequent runner-ups.

No named public announcement will be made without the winner’s consent, under the conditions set out in Article 16.

Article 10. Awarding of the prize

The prize is awarded in the form of a personalised travel voucher issued by the travel operator, sent to the winner within a maximum of thirty days following validation of her file. Date booking is carried out directly with the travel operator, in accordance with its general terms and conditions of sale, which are provided to the winner together with the travel voucher. The contact details strictly necessary for booking, namely the identity, date of birth and contact details of the two travellers, are transmitted to the travel operator for this sole purpose.

Article 11. Unclaimed prize

If, after the runner-up list has been exhausted, the prize cannot be validly awarded, it remains the property of the Organiser, who may dispose of it freely.

Article 12. Refunded orders, forfeiture and fraud

Only orders that have not been cancelled and not fully refunded as of the draw date entitle the participant to enter. Any order cancelled or refunded before the draw, in particular under the 60-day “satisfied or refunded” guarantee or the right of withdrawal, results in the cancellation of the corresponding entries.

Any refund, after the draw but before the prize is actually awarded, of the order(s) that gave rise to the winner’s entries results in the forfeiture of her right to the prize, which is then awarded to the first runner-up.

The Organiser reserves the right to disqualify any fraudulent entry obtained through multiple accounts, inaccurate contact details, automated processes, or any misuse of the Game mechanics, and to take any appropriate action in response to such conduct.

Article 13. Third-party brands

Club Med is a registered trademark of Club Méditerranée. Club Méditerranée is neither the organiser, nor sponsor, nor partner of the Game, and is cited only by way of reference for the exact description of the prize.

Article 14. Social networks

The Game is not organised, sponsored, or administered by Meta Platforms, operator of Facebook and Instagram, by TikTok, or by any other social media platform, all of which are fully released from any liability in relation to the Game. No sharing, mention or tagging on a social network is required to participate. The data transmitted as part of the Game are intended for the Organiser and not for the platforms.

Article 15. Personal data

The Organiser, as data controller, processes participants’ data, namely their identity, contact details and the order history strictly necessary to count entries, for the following purposes: management of the Game, designation of the winner, award of the prize, and compliance with legal obligations. The legal basis for the processing is the performance of these rules accepted by participation, and compliance with the Organiser’s legal obligations. No health data are collected or processed as part of the Game.

The winner’s data and that of her accompanying person strictly necessary for the booking are transmitted to the travel operator, for that sole purpose. Data relating to the Game are kept for the duration of the Game plus the applicable limitation periods, then deleted or archived in accordance with regulations.

In accordance with the General Data Protection Regulation and the French Data Protection Act, each participant has rights of access, rectification, erasure, restriction, objection and portability, which she may exercise by contacting bonjour@umawell.com. She also has the right to lodge a complaint with the CNIL or the supervisory authority in her country of residence. Exercising the right to object or to erasure before the draw constitutes a withdrawal from participation in the Game, without affecting the order.

Article 16. Image rights and communication about the winner

The Organiser may announce the results of the Game by stating the winner’s first name and the initial of her last name. Any use of the winner’s image, voice, full name or testimonials, in particular for communication about subsequent editions of the Game, is subject to the prior signing of a written authorisation, separate from these rules, specifying the media, duration and territorial scope of the use. No consideration is due, and no refusal may deprive the winner of her prize.

Article 17. Liability and force majeure

The Organiser's liability is strictly limited to awarding the prize as described in Article 5. The performance of transport, accommodation and catering services is the responsibility of the travel operator and the carriers, under the terms of their contracts and the applicable regulations.

The Organiser cannot be held liable for malfunctions of the internet network, email sending platforms or the umawell.fr website beyond its control, nor for their consequences on participation in the Game, subject to mandatory legal provisions.

In the event of force majeure or an external event making it impossible or dangerous to carry out the stay, in particular for health, climatic, security or geopolitical reasons, the Organiser may, without compensation, postpone the stay or replace the prize with a prize of at least equivalent value. The winner will be informed as soon as possible.

Article 18. Amendment of the Game

The Organiser reserves the right to shorten, extend, suspend, amend or cancel the Game if circumstances so require, without incurring liability as a result. Any amendment will be the subject of an addendum to these rules, filed in the same manner as these rules and brought to the attention of participants on the umawell.fr website.

Article 19. Filing and consultation of the rules

These rules are filed with an office of judicial officers, whose identity appears on the rules consultation page. They may be consulted free of charge throughout the Game Period at umawell.fr/pages/reglement-jeu-marrakech. A copy may be obtained free of charge upon simple written request sent to the Organiser; postage costs may be reimbursed at the applicable economy rate upon request.

Article 20. Applicable law, mediation and disputes

These rules are governed by French law, without prejudice to the mandatory protective provisions of the country of residence of the participants. In the event of any difficulty, any participant may send a complaint to bonjour@umawell.com. In accordance with Articles L611-1 et seq. of the French Consumer Code, participants may, free of charge, have recourse to the consumer mediator responsible for the Organiser, whose identity and contact details are set out in the general terms and conditions of sale on the umawell.fr website. Failing an amicable resolution, the dispute will be brought before the competent courts.
