ARTICLE 1 – PERSONAL INFORMATION COLLECTED

Orders & Browsing on Our Site

When you make a purchase or create a customer account on our site, as part of our buying and selling process, we collect the personal information you provide us that is necessary to prepare and deliver your package, such as your name, email address, postal address, and telephone number.

This order-related data is transmitted to our logistics providers who prepare and transport your package to your address. These providers are strictly prohibited from using your information for any purpose other than processing your order and must delete this data from their systems after processing. If you choose to have your package delivered outside Europe, your data, including your postal address, is necessarily transmitted to the carrier’s logistics services that will deliver your package in that country.

When you browse our site, we automatically receive the Internet Protocol (IP) address of your computer, which enables us to obtain further details about the browser and operating system you are using. In addition, data may be stored in or retrieved from your browser, generally in the form of cookies. These cookies collect information about you, your preferences, or your device and browser. They are generally established in response to actions you have taken that constitute a service request (e.g., placing an order).

Emails

If you have chosen to follow the news of Laboratoires üma by email (via the form on our site or by ticking the corresponding box during the purchase process), we use your email address to send you news about Laboratoires üma (new products, sporting events, meetings organized by Laboratoires üma, etc.) or to provide you with information regarding your purchase or browsing history on our site. Please note that if you no longer wish to receive these emails, you may unsubscribe at any time by clicking the “unsubscribe” link located at the bottom of the emails or by contacting us at bonjour@umawell.com. The unsubscription takes effect immediately.

The email marketing tool we use is based in the United States. It complies with the principles of the EU-US and Switzerland-US Data Privacy Shield. Moreover, as a “processor,” this email marketing tool is obliged to respect the legal requirements of the General Data Protection Regulation (GDPR).

Audience Measurement

We use audience analytics tools (such as Google Analytics) that allow us to better understand the activity on our site, how you react, and to improve the performance of our site to better match your usage. In this context, we provide these tools with data about your browsing history on our site and information about the products ordered. All data processed for statistical purposes outside Europe is completely anonymized.

Product Reviews

Your email address, first and last name, and order reference are transmitted to our partner who will send you a review form via email. Your email address is not published on our site when your review is displayed. These data are not transmitted to any other company and are used solely for the purpose of evaluating your experience with our products.

Advertising

Like many of our peers, advertising cookies are placed when you visit our site to subsequently display targeted advertisements when you browse other sites. The data collected is anonymous and is used solely for the functionality of advertising features.

How long is my personal data retained?

The length of time we retain your personal data depends on our business needs and our legal obligations.

For product purchases, we retain your data as long as it is necessary for the purposes for which it was collected (e.g., managing the commercial relationship between you and us), and for other purposes related to inventory management, while complying with applicable data security and retention laws.

If you consent to receive emails from Laboratoires üma to follow our news, your data is retained until you request to unsubscribe or have your personal data deleted, or after a period of inactivity (up to a maximum of 3 years from the last contact, such as a click in one of our emails).

In the event of creating a customer account, the data will be retained until you request its deletion or after a period of inactivity (up to a maximum of 3 years from the end of the commercial relationship, such as the last order, or from the last contact, such as a click in one of our emails).

When you contact us to obtain information about our products or our brand, or when you apply for a job, the data is retained for 3 years from the date of collection or your last contact initiated by you.

ARTICLE 2 – CONSENT

How Do We Obtain Your Consent?

When you provide us with your personal information to complete a transaction, verify your credit card, place an order, schedule a delivery, or return a purchase, we assume that you consent to the collection and use of your information solely for that purpose.

If we ask you to provide your personal information for any other reason, for example for marketing purposes, we will request your explicit consent directly or provide you with the option to refuse.

ARTICLE 5 – SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e‑commerce platform that enables us to sell our services and products to you.

Your data is stored within Shopify’s data storage system and databases, and in Shopify’s general application. Your data is kept on a secure server protected by a firewall.

Regarding these providers, we recommend that you carefully read their privacy policies so that you can understand how they will process your personal information.

Please note that some providers may be located or have facilities in a different jurisdiction from yours or ours. Therefore, if you choose to proceed with a transaction that requires the services of a third‑party provider, your information may then be governed by the laws of the jurisdiction in which that provider is located or where its facilities are situated.

For example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, your information used to complete the transaction may be disclosed under U.S. law, including the Patriot Act.

Once you leave our store’s website or are redirected to a third‑party website or application, you are no longer governed by this Privacy Policy or by the Terms and Conditions of our website.

They may be granted as part of:

  • Promotional offers or loyalty programs;
  • Partial or full refunds for a cancelled or returned Order;
  • Exceptional commercial gestures granted by Customer Service.

A voucher or store credit does not constitute a means of payment in itself and cannot be converted into cash.

10.2 Validity Period

All vouchers and store credits are valid for 12 months from the date of issuance. After this period, any unused balance will be permanently forfeited without the possibility of extension or refund.

10.3 Conditions of Use

Vouchers and store credits are redeemable for all Products available on the Site, excluding delivery fees.

They may not be combined with one another or with other promotional codes, except where expressly stated in the associated offer.

A voucher or store credit:

  • May be used only once (unless the Site’s system permits split usage);
  • May not be exchanged for cash or refunded via bank transfer;
  • May not be used after its expiration date.

If the value of the voucher or store credit is less than the total Order amount, the Customer must complete the payment using another accepted payment method.

10.4 Attribution and Transferability

  • Vouchers and store credits are issued in the name of and linked to the Customer’s account.
  • They may not be resold, transferred, or assigned to any third party.

11.1 Conditions for Use of Promotional Codes

Promotional codes apply solely to the base prices (i.e., non‑discounted prices) and may not be combined with any other discounts or promotions currently in effect, unless expressly stated otherwise.

Promotional codes may not be combined with one another nor with vouchers or store credits.

Each promotional code may be used only once per Customer account, unless otherwise instructed by Laboratoires üma.

11.2 Method of Use

The Customer must enter a valid promotional code in the designated field before confirming their Order.

Once the Order has been confirmed, it is no longer possible to add a promotional code retroactively.

Promotional codes are non‑exchangeable and non‑refundable, even in the event of a return or cancellation of the relevant Order.

If a Product purchased using a promotional code is returned in accordance with these Terms and Conditions, the Customer shall be refunded only the amount actually paid, and not the original price of the Product prior to the discount.

11.4 Validity Period and Limitations

Each promotional code has a specific expiration date, as indicated in the promotional offer.

Expired promotional codes may not be reactivated or applied to another Order.

Laboratoires üma reserves the right to cancel or modify any promotional offer at any time, particularly in cases of abuse or attempted fraud.

ARTICLE 14 – STATUTORY WARRANTIES

The Products marketed on the Site (umawell.fr) are covered by the statutory warranties provided under the French Consumer Code and the French Civil Code, which allow the Customer to return a defective or non‑conforming Product free of charge.

These warranties include:

  • The statutory warranty of conformity (Articles L.217‑4 et seq. of the Consumer Code);
  • The statutory warranty against hidden defects (Articles 1641 et seq. of the Civil Code).

14.1 Warranty Against Hidden Defects

In accordance with Articles 1641 et seq. of the French Civil Code, Laboratoires üma is obligated to guarantee the Customer against any hidden defects in the Products sold that render them:

  • Unfit for the intended use; or
  • So significantly diminished in usefulness that the Customer would not have purchased them or would have paid a lower price had the defect been known.

The Customer shall have a period of two years from the discovery of the hidden defect to initiate legal action.

In this case, after evaluating the defect, Laboratoires üma shall offer the Customer the choice between:

  • A full refund of the affected Product;
  • An exchange for an identical Product (or an equivalent one if the original is unavailable).

The warranty of conformity does not cover defects resulting from improper use, failure to adhere to the usage instructions, or normal wear and tear of the Product.

To benefit from any of the statutory warranties, the Customer must:

  • Notify Laboratoires üma by email at bonjour@umawell.com or via the contact form on the Site;
